By accessing or using the CustomSong website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our service. We may update these terms from time to time, and your continued use of the service constitutes acceptance of any changes.

Service Description

CustomSong provides a personalized song creation service. You complete a short quiz sharing details about a loved one (or yourself) — including their name, your relationship, qualities you admire, special memories, and a personal message. Based on your responses, we write and produce a custom, one-of-a-kind song in your chosen genre and deliver it to you via email.

Free Preview and Payment

After you submit your quiz, we create a free 30-second song preview so you can hear a sample before committing. There is no charge for the preview. If you love what you hear, you can purchase the full-length song through our secure checkout.

All payments are processed securely through Stripe. CustomSong does not store your credit card details or any sensitive payment information. By completing a purchase, you agree to pay the listed price for the delivery option you select.

Delivery and Access

Once your payment is confirmed, we produce your full song and deliver it to the email address you provided during the quiz. Delivery times depend on the option you select — standard delivery takes up to 3 days, and express delivery is completed within 24 hours. We make every effort to meet these timelines, but occasional delays may occur due to high demand.

Download and Ownership

Your song is delivered as a digital file via a private download link sent to your email. Once you download the song, it is yours to keep, share with family and friends, and enjoy for personal use. Please note that once a song has been downloaded, it is not eligible for a refund, as digital content cannot be returned.

Intellectual Property and License

CustomSong retains ownership of all intellectual property rights in the songs we create, including the composition, lyrics, and recording. Upon purchase, we grant you a personal, non-exclusive, non-transferable license to use, play, and share your song for personal, non-commercial purposes.

You may not resell, redistribute, sublicense, or use your song for commercial purposes (such as in advertisements, films, or public performances for profit) without our prior written consent. If you are interested in commercial licensing, please contact us at hello@custom-song.org.

Satisfaction Guarantee

We want you to love your song. If you are not completely satisfied with the final product, please contact us at hello@custom-song.org. We offer free revisions to adjust your song, and if we are unable to meet your expectations, we will provide a full refund in accordance with our Refund Policy. Your happiness matters to us.

Prohibited Content

CustomSong is designed to create meaningful, heartfelt music. We reserve the right to refuse any order that contains or requests:

• Hateful, discriminatory, or threatening language toward any individual or group
• Explicit sexual content or obscenity
• Content that promotes violence, illegal activity, or self-harm
• Defamatory statements or content that infringes on the rights of others

If we determine that a submission contains prohibited content, we will notify you and offer the opportunity to revise your request. If a suitable resolution cannot be reached, we will issue a full refund.

Limitation of Liability

CustomSong provides its services on an "as is" basis. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of data, emotional distress, or missed occasions. Our total liability for any claim shall not exceed the amount you paid for the specific song in question.

Chargebacks and Disputes

If you have any concerns about a charge, we kindly ask that you contact us at hello@custom-song.org before initiating a chargeback with your bank or credit card company. We are committed to resolving any issue promptly and fairly. Initiating a chargeback without first contacting us may result in delays and additional administrative steps for both parties.

Indemnification

You agree to indemnify and hold harmless CustomSong, its team, and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these terms, or your submission of content that infringes on the rights of any third party.

Technology and Production

CustomSong uses a combination of artificial intelligence (AI) and machine learning (ML) technologies to assist in the composition and production of your personalized song. While AI tools help us create music efficiently and at a high quality, every song is crafted from the unique details you provide. By using our service, you acknowledge and accept that AI/ML technology plays a role in the song creation process.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which CustomSong operates, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes will be subject to the exclusive jurisdiction of the courts in our operating jurisdiction.

Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable, while preserving the intent of the original provision.
